Please read these Terms of Use (“Terms”) carefully. They describe your rights and responsibilities and, together with our Privacy Policy and any other terms referred to below, form a legally binding agreement between you and NewHotDeals regarding your use of our website(s) and services.

 

These Terms contain a binding arbitration clause and a class action waiver. Section 18 contains an important note for New Jersey consumers.

Age Requirements: Our Services are intended for teenagers and adults. You must be at least 13 years old (or 16 years old if you are in the European Union or European Economic Area) to use the Services. We comply with the Children’s Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under 13. By registering or using the Services, you confirm you meet the age requirement and will provide accurate registration information.

 

You are responsible for keeping your password secure and for all activity that happens under your account. We may refuse any username that is inappropriate, impersonates someone else, or violates third-party rights.

Shopping and Product Purchases: On certain parts of our Services, you may browse or purchase products. Prices and availability can change at any time without notice. You may only purchase items for personal use or as a gift. You agree that all information you provide is accurate and that you are legally allowed to make the purchase. Some products may be used or contain used parts. We do not operate a call center. An order confirmation does not mean your order is accepted — we may cancel or limit orders for any reason. Product descriptions are provided “as is” and we do not guarantee they are error-free.

 

Adding and Using Coupons / Discount Codes: Users are welcome to contribute discount codes, vouchers, and opinions about their shopping experiences. All submissions are subject to our review and approval. We reserve the right to edit or remove any coupon or comment at any time. You are fully responsible for the accuracy and legality of anything you post. We are not liable for any comments or opinions left by users.

 

RetailMeNot Cash Back Services: If you participate in any cash back, rewards, or promotion offered through RetailMeNot, you agree to the specific Cash Back Rewards Terms (in addition to these Terms). Rewards are issued by RetailMeNot Rewards, LLC. All decisions about eligibility, approval, and redemption are made at our sole discretion. There are limits on the number of rewards per person per month, and rewards may be adjusted or canceled due to returns, cancellations, fraud, or other reasons. Inactive accounts may be charged maintenance fees or closed after 24 months.

 

Premium / Paid Services: Some features require payment (Premium Services). You are responsible for all charges, including recurring subscription fees. You authorize us (or our payment processor) to charge your chosen payment method. Subscriptions renew automatically unless you cancel at least 10 days before renewal. All payments are final except in cases of demonstrated fraud.

 

2. Your Use of Content

All content on our Services — including text, images, videos, logos, software, and design (“Content”) — is protected by copyright, trademark, and other intellectual property laws. You may use the Content only for your personal, non-commercial purposes.

We have the right (but not the obligation) to monitor, edit, or remove any content you post. We may also suspend or terminate your account at any time, for any reason, without prior notice.

 

5. Endorsements, Affiliate Links & Third-Party Sites

We may earn commissions or compensation when you click on certain links or make purchases through our Services (including affiliate links to retailers). We do not endorse or guarantee the accuracy of third-party content, products, or services. Any transactions you make with external merchants are solely between you and that merchant.

 

6. Indemnification

You agree to indemnify and hold NewHotDeals and our affiliates harmless from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Services, your posted content, or your violation of these Terms or any law.

 

7. Termination

We may restrict, suspend, or terminate your access to the Services at any time without notice. You may stop using the Services at any time. Upon termination, the Terms that by nature should survive (such as disclaimers, liability limits, and arbitration) will continue to apply.

 

8. Copyright Policy (DMCA)

We respect intellectual property rights. If you believe your copyrighted work has been infringed on our Services, please notify us at the contact details provided in our Privacy Policy or by emailing our legal team. We will respond appropriately, including removing allegedly infringing material when required. Repeat infringers may have their accounts terminated.

 

9. Disclaimer of Warranties & Limitation of Liability

The Services and all Content are provided “as is” and “as available” without any warranties. We do not guarantee uninterrupted access, error-free content, or that files are virus-free.

To the fullest extent permitted by law, NewHotDeals is not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of (or inability to use) the Services. Our total liability shall not exceed the greater of (a) fees you paid us in the past six months or (b) $100.

 

10. SMS Text Messaging

If you opt into any SMS programs we offer, you agree to receive recurring promotional messages. Standard message and data rates may apply. You can opt out at any time by replying STOP.

 

11–13. Member Disputes, International Use, Unsolicited Ideas

You are responsible for your interactions with other users. We are not liable for disputes between users.

If you access the Services from outside the United States, you do so at your own risk and must comply with local laws.

We do not accept unsolicited ideas for new products, features, or marketing.

 

14. Binding Arbitration & Class Action Waiver

Any dispute between you and NewHotDeals will be resolved through binding arbitration or small claims court rather than in court (with limited exceptions). Arbitration is individual only — no class actions or jury trials. Before filing arbitration, you must first send a formal Notice of Dispute and attempt informal resolution for 60 days.

15. Class Action and Jury Trial Waiver

You and NewHotDeals agree to bring claims only in your individual capacity and waive any right to participate in class, collective, or representative actions, to the fullest extent permitted by law. You also waive any right to a jury trial.

 

16. Limitation Period for Claims

Any claim arising from these Terms or your use of the Services must be filed within one (1) year after it arises, or it will be permanently barred.

 

17. Miscellaneous

These Terms represent the entire agreement between us. They are governed by the laws of the State of New York. Any disputes not subject to arbitration will be heard in the federal or state courts located in New York County, New York.

If any provision is found invalid, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right.

 

18. New Jersey Residents

To the extent New Jersey law applies, certain limitations in these Terms (including indemnification, disclaimers, and liability) do not limit any rights you may have as a consumer under New Jersey law.

 

19. Australia Residents

Nothing in these Terms limits any rights you may have under the Australian Consumer Law that cannot be excluded or modified.
